Terms of Service

Welcome to Amethyst! These Terms of Service ("Terms") govern your access to and use of the Amethyst mobile application and services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.
Important: Please read these Terms carefully before using our Platform. If you do not agree to these Terms, you may not access or use the Platform.
1. Acceptance of Terms
By creating an account, accessing, or using the Amethyst Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Definitions
- "Platform" refers to the Amethyst mobile application and all related services.
- "Customer" refers to users who book services through the Platform.
- "Provider" refers to service professionals who offer services through the Platform.
- "Services" refers to the various professional services offered by Providers through the Platform.
- "Booking" refers to a confirmed appointment between a Customer and a Provider.
- "Service PIN" refers to the unique verification code provided to Customers for service authentication.
3. Eligibility
You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that:
- You are at least 18 years of age
- You have the legal capacity to enter into these Terms
- You will provide accurate and complete information during registration
- You will maintain the security of your account credentials
- You will comply with all applicable laws and regulations
4. User Accounts
4.1 Account Registration
To use certain features of the Platform, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your password
- Notify us immediately of any unauthorized access or security breach
- Accept responsibility for all activities that occur under your account
4.2 Account Types
Customer Accounts: Allow you to browse services, book appointments, manage bookings, and provide reviews.
Provider Accounts: Allow you to offer services, manage availability, accept bookings, and receive payments. Provider accounts require additional verification and approval.
4.3 Account Suspension and Termination
We reserve the right to suspend or terminate your account if:
- You violate these Terms or any applicable laws
- You engage in fraudulent or abusive behavior
- You provide false or misleading information
- Your account poses a security risk to the Platform or other users
- We determine, in our sole discretion, that termination is necessary
5. Platform Services
5.1 Service Booking
Amethyst provides a platform connecting Customers with Service Providers. When you book a service:
- You enter into a direct service agreement with the Provider
- Amethyst is not a party to this service agreement
- You will receive a Service PIN to verify the booking with the Provider
- The Provider is solely responsible for the quality and delivery of services
- Payment is processed through the Platform, subject to our payment terms
5.2 Service PIN Verification
To ensure service authenticity and prevent fraud:
- Each booking generates a unique Service PIN
- You must provide this PIN to the Provider before service commencement
- Keep your Service PIN confidential and only share with the assigned Provider
- Report any unauthorized use of your Service PIN immediately
5.3 Pricing and Fees
All prices displayed on the Platform are in Sri Lankan Rupees (LKR). Pricing includes:
- Service Price: Set by the Provider for their services
- Platform Fee (5%): Charged by Amethyst for Platform use
- Applicable Taxes: As required by law
Providers may offer discounts at their discretion. Final prices are confirmed before booking completion.
6. Payment Terms
6.1 Payment Methods
We accept the following payment methods:
- Cash on Service (pay the Provider directly upon service completion)
- Credit/Debit Cards (processed securely through our payment partner)
- Mobile Payment (eZ Cash, Dialog Pay, and other supported wallets)
6.2 Payment Processing
When you book a service:
- Payment authorization is obtained at the time of booking
- For card and mobile payments, funds are held until service completion
- For cash payments, payment is made directly to the Provider
- A platform fee of 5% is applied to all bookings
6.3 Refunds and Cancellations
Cancellation and refund policies vary by Provider and timing:
- Cancellation more than 24 hours before service: Full refund minus processing fees
- Cancellation 12-24 hours before service: 50% refund
- Cancellation less than 12 hours before service: No refund
- Provider cancellation: Full refund automatically processed
- No-show: No refund
Refunds are processed within 5-7 business days to the original payment method.
7. Provider-Specific Terms
7.1 Provider Approval
To become a Provider, you must:
- Submit required identification and business documents
- Provide proof of relevant certifications or licenses
- Pass our verification and background check process
- Agree to our Provider Service Standards
- Maintain active status by completing regular bookings
7.2 Service Delivery
As a Provider, you agree to:
- Arrive on time for scheduled bookings
- Verify the Customer's Service PIN before starting service
- Deliver services professionally and to industry standards
- Maintain necessary equipment and supplies
- Comply with all applicable health and safety regulations
- Report completion of services through the Platform
7.3 Provider Payments
Provider earnings are calculated as:
- Service Price (as set by Provider) minus Platform Fee (5%)
- Payments are transferred to your registered bank account
- Payment frequency: Weekly or monthly (based on Provider preference)
- Minimum payout threshold: Rs. 1,000
7.4 Punctuality Score
We track Provider punctuality to maintain service quality:
- On-time arrival counts as a positive score
- Late arrivals (5-15 minutes) reduce your punctuality score
- Very late arrivals (over 15 minutes) significantly impact your score
- Consistently low punctuality scores may result in account review or suspension
8. User Conduct
You agree NOT to:
- Use the Platform for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Infringe on intellectual property rights
- Transmit viruses, malware, or harmful code
- Harass, abuse, or harm other users
- Impersonate any person or entity
- Collect or store personal data of other users
- Interfere with or disrupt the Platform's operation
- Attempt to circumvent security measures
- Book services with no intent to complete them
- Share Service PINs with unauthorized parties
9. Reviews and Ratings
Customers may leave reviews and ratings for Providers. You agree that:
- Reviews must be honest, accurate, and based on actual experience
- Reviews may not contain offensive, defamatory, or discriminatory content
- We reserve the right to remove reviews that violate our policies
- Reviews become public and may be displayed on Provider profiles
- Providers may not solicit fake reviews or offer incentives for positive reviews
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Amethyst acts as an intermediary platform connecting Customers and Providers
- We are not responsible for the quality, safety, or legality of services provided
- We are not liable for Provider conduct, performance, or failure to perform
- We are not liable for any direct, indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid by you for the specific service
- We do not guarantee Platform availability, accuracy, or error-free operation
11. Indemnification
You agree to indemnify, defend, and hold harmless Amethyst, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any rights of another party
- Services provided by or to you through the Platform
12. Intellectual Property
All content, features, and functionality on the Platform, including but not limited to text, graphics, logos, icons, images, audio, video, software, and compilation thereof, are the exclusive property of Amethyst and are protected by copyright, trademark, and other intellectual property laws.
You may not:
- Copy, modify, distribute, or create derivative works from Platform content
- Use automated systems to access or collect data from the Platform
- Remove or alter any copyright, trademark, or proprietary notices
13. Privacy and Data Protection
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Posting the updated Terms on the Platform
- Updating the "Last Updated" date
- Sending email notifications for significant changes
Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
15. Termination
You may terminate your account at any time by contacting us. Upon termination:
- Your right to access and use the Platform will cease immediately
- Outstanding payments and obligations remain in effect
- We may retain certain information as required by law or for legitimate business purposes
16. Dispute Resolution
16.1 Informal Resolution
Before filing any formal claim, you agree to contact us and attempt to resolve disputes informally.
16.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Sri Lanka, without regard to its conflict of law principles.
16.3 Jurisdiction
Any disputes arising from these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Amethyst.
17.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17.3 Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
17.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
